Terms of sale
These general terms of sale govern orders placed on La Chocolaterie’s website, by consumers and businesses alike: prices, payment, delivery, in-store pickup and guarantees.

2. Scope
These general terms of sale apply to every order placed on the website by a consumer or a business. The customer accepts them by placing an order; the terms that apply are those in force on the date of the order.
For businesses, a quote or specific terms accepted in writing may supplement these terms; they prevail in case of conflict.
3. Products
Products are described on their page with the greatest care. Photographs are for illustration: slight differences in appearance may occur, especially for handmade products. The composition, ingredients and allergens of each product are available on request before ordering.
Our chocolates are prepared for your order. Some selections are seasonal or available in limited quantities; should a product run out after the order, we will let you know and offer an equivalent product or a refund of the item.
4. Prices
Prices are in euros, all taxes included (8.5% VAT applicable in La Réunion). The price charged is the one displayed when the order is confirmed.
Delivery costs are added to the price of the products and shown before payment. They depend on the amount of the products before discount:
- €29.90 for an order under €500;
- €39.90 from €500 up to and including €1,000;
- €59.90 above €1,000.
In-store pickup is free.
Volume discounts apply automatically depending on the order amount, and promotional codes may be offered; their conditions are shown on the website. Only one discount applies per order: the most favourable to the customer.
5. Ordering
A minimum order amount applies; it is shown in the cart. To order, the customer fills the cart, enters their details, chooses delivery to an address in La Réunion or pickup in one of our shops, checks the summary and proceeds to payment.
The sale is concluded when the payment is accepted. A confirmation email summarising the order is then sent to the customer. La Chocolaterie may refuse or cancel an order in the event of an existing dispute with the customer, a declined payment or a manifestly abnormal order.
6. Quotes and business orders
A quote can be generated from the cart. It is valid for 30 days. The corresponding order is prepared once payment is received, by bank transfer to the account shown on the quote or online.
Personalised orders (messages, cards, packaging, assortments) and large orders are subject to conditions set out when the quote is confirmed, in particular regarding lead times and cancellation.
7. Payment
Online payment is due when ordering. It is made by bank card, including Apple Pay and Google Pay, or by the other methods offered at checkout. It is processed by our secure payment provider, Stripe: La Chocolaterie never has access to your full card details and does not store them.
8. Delivery and pickup
We deliver across the island of La Réunion only, by refrigerated transport that preserves the quality of the chocolates. Delivery is made to the address given by the customer, who ensures it is correct and that someone is present to receive the order.
The delivery date is agreed with the customer, as close as possible to their distribution date; allow more time during the holiday season. Unless a date has been agreed, the order is delivered no later than 30 days after it was placed. In case of delay, the customer may, after giving us formal notice to deliver within a reasonable additional period, cancel the sale and be refunded.
Pickup is free in our shops in Saint-Denis (16 rue Sainte-Anne) and Sainte-Marie (Duparc shopping centre). The customer is notified when the order is ready and brings their order number.
On receipt, the customer checks the condition of the parcel and the products. Any damaged, missing or non-conforming product must be reported as described in our return policy.
9. Right of withdrawal
Under article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods liable to deteriorate or expire rapidly, nor to goods made to the customer’s specifications or clearly personalised. As our chocolates fall into these categories, orders cannot be withdrawn. Orders placed by businesses do not carry this right either.
An order can nevertheless be cancelled or changed as long as its preparation has not started: contact us as soon as possible.
10. Legal guarantees
Consumers benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
Under the guarantee of conformity, the consumer has two years from delivery to obtain the replacement of a non-conforming product or, failing that, a price reduction or the cancellation of the sale. Under the guarantee against hidden defects, they have two years from the discovery of the defect to obtain a price reduction or the cancellation of the sale. These guarantees are free of charge and apply regardless of any commercial gesture.
For a damaged or defective product, or one different from the order, the steps to follow are described in our return policy.
11. Storage and liability
Chocolates keep in a cool, dry place, away from light and heat, and are best enjoyed before the date shown. La Chocolaterie cannot be held liable for any deterioration caused by improper storage after delivery or pickup.
La Chocolaterie is not liable for failure to perform its obligations in the event of force majeure.
12. Personal data
The data provided with an order is used to process, deliver and invoice it. How it is processed and your rights are described in our privacy policy.
13. Complaints, mediation and disputes
Any complaint should be sent to contact@lachocolaterie.re or made by phone on +262 262 20 44 22. We undertake to seek an amicable solution with you.
Failing an agreement, consumers may refer the matter free of charge to the consumer mediator La Chocolaterie belongs to: [To be completed: name, address and website of the mediator].
These terms are governed by French law. Failing an amicable settlement, the dispute will be brought before the competent court under ordinary rules; between businesses, the courts of Saint-Denis de La Réunion have sole jurisdiction.
